We do not use automated decision-making processes under Article 22 GDPR that could significantly affect you legally or otherwise. If you have given us consent under Article 9 GDPR to anonymize your personal data, you have agreed to the following:

X. Additional Information on Video Recruiting
- Purpose and Data Controller
Our SaaS is designed to provide an objective personality profile by analyzing video and audio recordings using artificial intelligence. Tenacor LLC acts on behalf of employers who are the data controllers. The SaaS analyzes facial expressions, voice, and speech patterns to evaluate responses during video interviews.
- Data Processed
By using our service, you may upload documents such as your resume (referred to as "User Generated Content"). Personal data processed may include your name, skills, contact information, and video/audio recordings.
- Consent for Video Recording and Analysis
With your consent under Article 9 II a GDPR, the video recordings will be processed for the following:
- Video Analysis: Using facial expression recognition technology to assess emotions.
- Voice Analysis: Quantification of voice patterns (e.g., arousal, emotional tone).
- Speech Analysis: Conversion of speech to text and analysis of clarity, sentiment, and word count.
By using the service, you expressly consent to the processing and storage of these data. You can withdraw consent at any time, and opting out will not prevent your application from proceeding.
- Data Storage and Access

XI. User Account Information for Employers
To activate and use certain features of our SaaS, you will need to create an account, which may include personal data such as:

- Name and company details
- Position/department
- IP address
- Time-stamp of registration
This data allows us to provide access to our services. Device-related information, log data, and location data may also be collected for service personalization and enhancement.

For accessing our SaaS platform, we may offer future login options via Google or LinkedIn.

1. Binding Agreement
- 1.1Tenacor LLC (“Tenacor LLC,” “we,” “us,” and “our”) provides a platform that facilitates interactions between potential employers and job candidates. By accessing and using the Platform, you agree to comply with and be bound by the terms of this Agreement.
- 1.2We may update the terms of this Agreement from time to time. Changes will be communicated to you via the email address provided upon registration or through an announcement on the Platform. The updated terms will apply upon notification. Your continued use of the Platform after such notice indicates your acceptance of the revised terms.
2. Definitions
In this Agreement, the following terms have the meanings described below:
- "Candidate" refers to a user who creates a Candidate Profile to search for employment opportunities or apply for jobs with Employers.
- "Candidate Profile" refers to the profile created by a Candidate, which may include personal details, resume, photo, video, skills, and professional interests.
- "Employer" refers to a user who accesses the Platform to seek, screen, or assess candidates for employment.
- "Intellectual Property Rights" means all patents, trademarks, service marks, logos, copyrights, trade secrets, database rights, and other intellectual property rights (whether registered or unregistered) protected by applicable laws, along with all applications, renewals, and extensions of the same.
- "Personal Data" refers to data that can identify an individual, either directly or when combined with other information.
- "Platform" means the services and features provided by Tenacor LLC or its affiliates, whether directly or through APIs or hyperlinks.
- "User Content" includes all information submitted or posted by users on or through the Platform, including job postings by Employers and Candidate Profiles.
3. Registration
- 3.1To register an account on the Platform, you must be at least 18 years old.
- 3.2During registration, you must create a Candidate Profile. You agree to ensure that all information you provide is accurate, current, and complete.
- 3.3We may delete your account and associated information if there is a period of inactivity, after providing you with prior notice.
- 3.4You may cancel your registration at any time by notifying us in writing. Upon cancellation, you agree to cease accessing and using the Platform.
4. Password and Security
- 4.1You agree to maintain the confidentiality of your login credentials and not share them with third parties.
- 4.2You are fully responsible for all activities conducted using your account, whether or not authorized.
- 4.3Notify us immediately if you suspect any unauthorized use of your account.
- 4.4If we believe there has been a breach or misuse of your account, we may require a password reset or suspend your account.
- 4.5You are liable for any losses or damage resulting from unauthorized access or misuse of your login details and agree to indemnify Tenacor LLC against any associated losses.
5. Use of Platform
- 5.1Tenacor LLC grants you a limited, non-exclusive right to access and use the Platform for personal, non-commercial purposes, such as seeking employment, applying for jobs, or related activities.
- 5.2This access is personal to you and may not be transferred or assigned to others.
- 5.3You may be required to participate in activities such as interviews, assessments, or tests, which may be recorded. You consent to the recording of such activities and the use of your name, likeness, and Candidate Profile as described in Clause 9 (Personal Data).
- 5.4You agree not to use the Platform for unlawful purposes or in any manner that could harm the Platform, other users, or violate this Agreement, including but not limited to:
- Disseminating false, harmful, or abusive content.
- Copying, reproducing, or exploiting Platform content without permission.
- Interfering with other users' access or the Platform's functionality.
- Applying for jobs on behalf of another person.
- Engaging in unauthorized access or activities that disrupt the Platform.
- Posting content that violates any terms of this Agreement.
- 5.5We reserve the right to remove, edit, or suspend any user content or account that violates these terms.
6. Availability of Services
- 6.1We will make reasonable efforts to ensure the Platform is available at all times, but we cannot guarantee uninterrupted or error-free access.
- 6.2Access may be temporarily restricted for maintenance, updates, or repairs, and we will restore access as soon as reasonably possible.
7. Intellectual Property
Unless otherwise stated in Clause 8 (User Content), Tenacor LLC owns all Intellectual Property Rights in the Platform and its content. You may not reproduce, modify, or use this content for commercial purposes without our written consent, except as allowed under this Agreement or applicable law.
8. User Content
- 8.1You retain ownership of any User Content you provide, but by submitting content, you grant Tenacor LLC a non-exclusive, worldwide, royalty-free license to use, reproduce, and distribute it as needed.
- 8.2We do not guarantee the accuracy or reliability of User Content and are not responsible for any reliance placed upon it.
- 8.3You are responsible for all User Content you submit.
- 8.4We may remove or modify User Content if it violates this Agreement or applicable laws.
9. Personal Data
- 9.1Collection of Personal Data: We may collect Personal Data directly from you, automatically through your use of the Platform, or from third parties (e.g., Employers).
- 9.2Purpose and Use of Personal Data: We use your Personal Data to operate and improve the Platform, process job applications, personalize your experience, communicate with you, and comply with legal obligations.
- 9.3Withdrawal of Consent: You may withdraw your consent for the collection and use of your Personal Data at any time by notifying us in writing. Please note that withdrawal may affect your use of the Platform.
- 9.4Access and Correction: You may request access to or correction of your Personal Data by contacting our Data Protection Officer.
- 9.5Retention of Personal Data: We will retain your Personal Data for as long as necessary for the purposes for which it was collected or as required by law.

- 11.3Certain provisions, such as those concerning Intellectual Property, Limitation of Liability, Disclaimers, and Indemnity, will survive termination.
12. Limitation of Liability
- 12.1The Platform is provided "as is," and we make no guarantees regarding its content or performance.
- 12.2To the fullest extent permitted by law, we exclude all implied warranties and limit our liability to you for any claims to S$100.
13. Disclaimer
- 13.1We are only a platform provider and are not responsible for the hiring decisions of Employers.
- 13.2We are not liable for any damage or loss resulting from decisions made by Employers.
- 13.3We are not responsible for any interruptions, suspensions, or errors in the Platform or its content.
14. Indemnity
You agree to indemnify Tenacor LLC and its affiliates against any claims arising from your use of the Platform or breach of this Agreement.
15. Applicable Law
This Agreement is governed by the laws of US.
16. Dispute Resolution
- 16.1Disputes will be resolved through arbitration at the US International Arbitration Centre (SIAC) in accordance with its rules.
- 16.2The arbitration will take place in the US and be conducted in English.
- 16.3A mediator from the US International Mediation Centre will assist before arbitration proceedings commence.
17. Miscellaneous
- 17.1You may not assign your rights under this Agreement, but we may assign them at our discretion.
- 17.2No third party may enforce this Agreement under the Contracts (Rights of Third Parties) Act.
- 17.3Failure to enforce any provision does not waive our right to do so in the future.
- 17.4If any provision is deemed unenforceable, the remainder of the Agreement remains in full force.
